Terms of sale.
These are the terms on which Kalmely Ltd sells products through kalmely.com. They are written in plain English and bind both parties when you place an order.
1. The contract
When you place an order through kalmely.com, you make an offer to buy. The contract is formed only when we send you an order confirmation email. If we cannot fulfil your order — for example, if a bundle is out of stock — we will refund you in full within 5 working days and the contract will not come into being.
2. Eligibility
You must be at least 18 years old to place an order. By completing checkout you confirm that you are 18 or older and that the payment details you have provided belong to you or are used with the cardholder's permission.
3. Price and payment
All prices on kalmely.com are shown in US dollars and include VAT where applicable. Shipping is free. We accept Visa, Mastercard, American Express, Apple Pay, Google Pay, Klarna and Clearpay.
If you choose Klarna or Clearpay, your contract for the loan or instalment plan is with that provider directly. Their terms apply alongside ours.
4. Delivery
Kalmely ships from our EU warehouse. UK orders typically arrive in 5–7 business days. We do not currently ship outside the United Kingdom — please check our shipping policy for the most current list of destinations.
Risk and title pass to you on delivery. If the parcel is visibly damaged on arrival, please refuse it and let us know within 48 hours.
5. Right to cancel (UK Consumer Contracts Regulations)
If you are a consumer based in the United Kingdom, you have the right to cancel this contract within 14 days of receiving your Kalmely, without giving any reason. To cancel, email hello@kalmely.com with your order number and the words "I wish to cancel".
You will need to return the device to us at your own cost in saleable condition. We will refund the price paid within 14 days of receiving the returned device.
6. 30-day money-back (additional to your statutory rights)
In addition to the statutory 14-day right above, we offer an extended 30-day money-back guarantee. If Kalmely does not help you within 30 days of receipt, contact us with your order number and we will refund you in full. You do not need to return the device. Full details: refund policy.
7. Warranty
Kalmely is covered by a 12-month manufacturer warranty against defects in materials and workmanship under normal home use. The warranty does not cover damage caused by misuse, dropping, exposure to liquids, or unauthorised modification.
Your statutory rights under the UK Consumer Rights Act 2015 are not affected.
8. Acceptable use
Kalmely is intended for personal home use only. Do not use the device if you have an active scalp wound, recent head surgery, an implanted electronic device near the head, or if you are under the care of a clinician who has advised against scalp compression or heat therapy.
This product is not a medical device. Statements on our site have not been evaluated by the FDA or the UK MHRA. Kalmely is not intended to diagnose, treat, cure, or prevent any disease, including migraine. If migraine is interfering with your life, please speak to your GP or a headache specialist.
9. Liability
We accept liability for foreseeable losses caused by our breach of these terms or by our negligence. We do not exclude or limit liability for death, personal injury caused by our negligence, or for fraud.
We will not be liable for losses that are not foreseeable, or for any loss of profits, loss of opportunity, or business interruption arising from your use of Kalmely.
10. Marketing communications
By placing an order you do not automatically subscribe to marketing email. We will only contact you about the order itself unless you opt in to our newsletter. You can unsubscribe at any time using the link at the bottom of every marketing email.
11. Disputes and governing law
These terms are governed by the laws of England and Wales, and any disputes are subject to the exclusive jurisdiction of the courts of England and Wales. If you live in Northern Ireland or Scotland, you can also bring proceedings in your local courts.
Under the EU Online Dispute Resolution platform, you have the right to refer disputes to an alternative dispute resolution provider: ec.europa.eu/odr.
12. Changes to these terms
We may amend these terms occasionally — for example, to reflect changes in law, new payment options, or new shipping destinations. The version that applies to your order is the one displayed on the site at the time you placed it. The "Last updated" date at the top of this page always reflects the current public version.
